Facing deportation, Shayne Paul Montgomery tried to use the precedent set last year in the high court’s ruling on the ‘Love and Thoms’ case.
The federal government has expressed that they seek to overturn this ruling that gave Aboriginal aliens protection from being deported.
Montgomery, who identifies and is recognized as Aboriginal, does not have a biological connection to the country, and thus raises the question of whether he has the same protections.
